Even though the contract says the buyer is responsible for the property from 5:00 pm on the first business day after the contract date, we strongly recommend regardless of whether you’re buying or selling, to keep the property insured until settlement.  This way you’re fully protected if anything unexpected happens before the sale is complete.

Yes. In Queensland, the deposit specified in the Contract of Sale is payable by the buyer to the deposit holder. The deposit:-

  • Secures the contract: demonstrates your commitment to the purchase.
  • Is usually held in a trust account:  most residential sales, the deposit is held by the seller’s real estate agent or the seller’s solicitor until settlement.
  • Is required to be paid within the agreed timeframe: The contract will state when the deposit must be paid, either on signing of the contract and/or commonly within 3-5 business days after the contract date. Failing to pay the deposit on time may give the seller the right to terminate the contract and the buyer will forfeit the deposit to the seller.

Our conveyancing team will guide to understand the deposit amount, how it is held, and the due date to make sure the payment complies with the contract and protects your interests.

We recommend you notify your bank (or lender) as soon as a Contract of Sale has been signed.  This is because your lender will require you to complete and sign a Discharge Authority Form so they can release the mortgage from the property at settlement.

Lenders can take up to 10–15 business days (sometimes longer) to process a discharge request, so early notice helps avoid settlement delays.

Some lenders discharge authority are only valid for short period.  Always check your lender’s discharge form or contact them directly to confirm the exact validity period and processing times for your situation.
