Whitsunday Landlords And Tenants Be Aware

New Council Trade Waste Management Plan

For those of our clients who are either Landlords or Tenants of premises in the Whitsunday Regional Council area with Trade Waste facilities, an important change has recently been approved by the Whitsunday Regional Council regarding the issue of Trade Waste.  Macrossan & Amiet Solicitors wishes to advise that the Whitsunday Regional Council has approved for introduction a new Trade Waste policy and management plan for the Whitsunday Region.

For any properties or businesses be it existing or new, which require a trade waste system and approval from Council, stakeholders must be aware of upcoming changes as a result of the introduction of the new Trade Waste policy and management plans.

The introduction of the plan will be staged to take place over the next three years and Council will make available resources to assist those parties requiring such Trade Waste Permits.

Perhaps the most fundamental change as a result of the introduction of the new Trade Waste policy and management plan is that Landlords will now be responsible for the installation and maintenance of Trade Waste Systems rather than Tenants and tied to this is that annual Trade Waste Permit fees will be billed directly to the Property Owner/Landlord rather than the Tenant.

It is clear then that this will impact our Landlord clients as well as our Tenant clients in the Whitsunday Region.  The Council is in the process of offering to all effected Property Owners and Businesses, the opportunity to meet with Council Staff to discuss the changes and will be holding public information sessions throughout the region as the role out of the plan progresses.

If you are a Tenant wanting information as to how this will affect the day to day operation of your business, please contact our office to discuss the matter with one of our experienced members of staff.  If you are a Landlord who wants advice as to whether the contents of your current Lease is satisfactory having regard to the announced changes, similarly, contact our office.
