The upcoming trial of Phillip Abell, Benjamin Power and Donna McAvoy for the murder of Detective Senior Constable Damian Leeding at the Pacific Pine Tavern in May 2011 is a stark example of how a common criminal purpose may be relied upon by the prosecution notwithstanding that there may be unanticipated consequences. It’s that time of the year again. We have just celebrated Melbourne Cup, schoolies is just around the corner, office Christmas parties are in full swing and the summer festival season is about to begin.
